These Terms of Use ("Terms") govern your access to and use of CreatorPlex — the AI-powered creator-commerce platform ("Service") operated by CreatorPlex Technologies Pvt. Ltd. ("CreatorPlex"). By creating an account or using the Service, you agree to these Terms.
1. Who can use CreatorPlex
You must be at least 18 years old and legally able to enter into contracts. Brands must be a registered business (Proprietorship, LLP, Pvt. Ltd., or equivalent). Creators must own the social handles they connect. Creators under 18 may only join with a parent/guardian who agrees to these Terms on their behalf.
2. Accounts and workspaces
- Every brand belongs to a "workspace" — one billing entity with roles: owner, admin, manager, analyst.
- You are responsible for all activity under your account. Keep your password secret. Notify us within 24 hours of any suspected unauthorised access.
- We may suspend accounts that violate these Terms, contain fraudulent activity, or fail payment.
3. Campaigns and creator relationships
CreatorPlex is a marketplace + workflow tool. Brands and creators enter into their own commercial relationship — CreatorPlex is not a party to those contracts. Every accepted invitation generates a machine-readable contract that both sides agree to. Deliverables, usage rights, and compensation are set per campaign.
4. Payments, fees, and escrow
- Brands pay creator fees + a platform fee (currently 10% for paid, 5% for barter) + payment processing markup.
- Paid fees are held in escrow for the number of days set in Admin → Settings (default 7 days) after content is approved.
- Refunds for approved-but-unused campaign funds return to the brand's original payment method within 7 business days.
- Creator payouts are sent via Stripe Connect (or the enabled provider) after the escrow window ends.
5. Content licensing
Unless a campaign brief states otherwise, brands receive a 90-day paid usage license on delivered content for the geography you operate in. Perpetual buyouts, exclusivity, and whitelisting must be negotiated separately in the campaign brief.
6. Prohibited conduct
- No misrepresentation of follower counts, engagement, or audience demographics.
- No buying followers, bots, or fake engagement.
- No off-platform circumvention of CreatorPlex's escrow or attribution once creators are matched via the Service.
- No content that violates local law, promotes hate, glorifies self-harm, or is sexually explicit involving minors.
7. Intellectual property
CreatorPlex's platform, brand, code, and content are ours. You retain ownership of everything you upload; you grant us a limited license to store, display, and process it to operate the Service.
8. Liability
CreatorPlex is provided "as is". To the maximum extent permitted by law, our liability for any claim relating to the Service is limited to the fees you paid us in the 3 months preceding the claim.
9. Governing law
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of New Delhi.
10. Changes
We may update these Terms. Material changes are notified in-app 14 days before they take effect.
